I'm Ciel from Famigo who tells you about the law and visa common sense in Korea every day.


Those who work part-time as D-2s or work in small businesses are excluded from many benefits.

It is a problem such as not receiving night pay or being excluded from retirement benefits.

The Labor Standards Act does not apply to "workplaces with fewer than five employees" to reduce the economic burden on small business owners and SMEs.


The Ministry of Economy has expressed its willingness to expand the Labor Standards Act to workplaces with fewer than five employees.

야간 수당을 못 받거나, 퇴직금 대상에서 제외되는 등의 문제인데요.

가장 합법적이면서도 큰 이유는 사업장의 규모가 작다는 점이라 사료됩니다.


‘5인 미만 사업장’에는 소상공인 및 중소기업의 경제적 부담을 줄이기 위해 근로기준법이 적용되지 않는데요.


경제부에서 근로기준법을 5인 미만 사업장에도 확대하겠다는 의지를 밝혔습니다.


현재 연구용역 과정에 들어가 있는 상태이며, 현재 안대로 적용될 경우 주 52시간 근로 제한, 연장·휴일·야간근로수당, 연차휴가, 공휴일 유급휴무, 부당해고 금지 분야에서 사업장 규모와 상관없이 혜택을 받을 수 있을 것이라 생각됩니다.
