Recently, more and more foreign workers are receiving salaries with stablecoins, one of the bitcoin.
The reason is that the won has low currency exchangeability and high remittance fees.
As a result, foreigners who are staying illegally are also asking their employers to pay their salaries in stablecoins, not in Korean won.
This is very dangerous.
Today, as we look at the relevant laws together, I would like to tell you why it is dangerous to get paid in stablecoins.
1. About 'wage' under the Labor Standards Act
- The term "wage" means all money and goods paid by an employer to an employee in exchange for work, such as wages, salaries, or any other name.
- Therefore, receiving stablecoins in exchange for work can be seen as "wage" under the Labor Standards Act.
2. a matter of tax
- Freelance workers are obliged to pay comprehensive income tax and local income tax on all income generated, and are obliged to pay that cost if they work at four major insurance businesses.
- However, if you are paid with stablecoins, it is difficult to prove in situations such as unpaid wages, and you may be accused of being deferred to tax evasion because you do not take taxes.
- In particular, non-payment of taxes at workplaces can lead to the termination of visas due to the closure of workplaces, and even if the workplace is maintained, individuals who have evaded taxes are very likely to be deprived of their visas.
- For visa-free illegal immigrants, entry to Korea may be restricted or disadvantaged in the future (rejecting entry even though it is just and complete document preparation and visa application).
- Additional taxes are added to the taxes you have to pay, which could be a bigger economic burden.
It also seems quite dangerous to say no if you pay with stablecoins at the workplace and claim to receive your wages directly with stablecoins.

2. 세금의 문제
- 프리랜서 근로자는 발생하는 모든 소득에 대해 종합소득세와 지방소득세를 낼 의무가 있으며, 4대보험 사업장에서 근무를 할 경우 해당 비용을 지불해야 할 의무가 있습니다.
- 하지만, 스테이블 코인으로 임금을 받을 경우, 임금 미납 등의 상황에서 증명하기 어렵고, 세금을 떼지 않기 때문에 탈세에 연류되었다는 혐의를 받을 수 있습니다.
- 특히, 사업장의 세금 미납은 사업장의 폐쇄로 인한 비자 해지로 이어질 수 있으며, 사업장이 유지되더라도 탈세한 개인은 비자가 박탈당할 가능성이 매우 높습니다.
- 무비자 입국 불법체류자의 경우, 향후 한국 입국이 제한되거나 불이익(정당하고 완벽한 서류 준비 및 비자 신청임에도 입국거부)이 발생할 수 있습니다.
- 내야할 세금에 가산세가 붙어, 더 큰 경제적 부담으로 다가올 수 있습니다.
업장에서 스테이블 코인으로 임금을 지급한다면 거절하고, 직접 임금을 스테이블 코인으로 받겠다고 주장하시는 것도 상당히 위험해 보입니다.
